1. Acceptance of Terms

By engaging ID Website Designs (“we”, “us”, “our”) for services or using our website, you (“client”, “you”) agree to these Terms and Conditions.

 

2. Services

ID Website Designs provides website design, development, digital marketing, graphic design, and related services primarily for small businesses.

All services will be outlined in writing (proposal, invoice, or agreement) before work begins.

 

3. Quotes and Pricing

  • All quotes are valid for 30 days unless stated otherwise.

  • Prices are in AUD unless specified.

  • Additional work outside the agreed scope may incur extra charges.

  • We reserve the right to adjust pricing for significant scope changes.

4. Payment Terms

  • A non-refundable 50% deposit is required before work commences.

  • Final payment is due prior to website launch unless otherwise agreed.

  • Late payments may result in project delays or suspension of services.

  • All fees are non-refundable once work has commenced, unless required by Australian Consumer Law.

 

5. Client Responsibilities

The client agrees to:

  • Provide accurate content, images, and materials

  • Ensure they have rights to all supplied content

  • Provide timely feedback and approvals

  • Review the website before launch

Delays in client response may affect delivery timelines.

 

6. Revisions

Reasonable revisions are included as outlined in your proposal. Excessive revisions or changes outside scope may be billed additionally.

 

7. Intellectual Property

 

7.1 Client Materials

You retain ownership of content you provide.

 

7.2 Website Ownership

Upon full payment:

  • The client owns the completed website design (excluding third-party tools, themes, plugins, or licensed assets).

  • ID Website Designs retains the right to display the project in our portfolio unless otherwise agreed in writing.

 

8. Third-Party Services

We may use third-party tools (e.g., hosting, plugins, payment gateways). We are not responsible for:

  • Third-party outages

  • Security breaches on external platforms

  • Changes in third-party pricing or policies

 

9. Website Performance and SEO

While we apply best practices, we do not guarantee:

  • Specific Google rankings

  • Traffic levels

  • Sales or business outcomes

 

10. Limitation of Liability

To the maximum extent permitted by Australian law, ID Website Designs is not liable for:

  • Loss of profits

  • Business interruption

  • Data loss

  • Indirect or consequential damages

Our total liability is limited to the amount paid for the relevant service.

Nothing in these terms excludes rights under the Australian Consumer Law.

 

11. Termination

We may suspend or terminate services if:

  • Payments are overdue

  • The client breaches these terms

  • The project becomes inactive for an extended period

Clients may terminate in writing; however, completed work and time spent remain payable.

 

12. Governing Law

These Terms are governed by the laws of Western Australia, Australia.
